These Terms of Service ("Terms") govern your access to and use of the LUSBY website, online store, products, content, features, and related services.

By accessing our website or placing an order, you agree to these Terms.

Nothing in these Terms limits any consumer right or other legal protection that cannot lawfully be excluded.

1. About LUSBY

LUSBY operates an online store offering smart wearable products, including AI-enabled smart glasses and related accessories.

Our online store is powered by Shopify.

2. Eligibility and Lawful Use

You may use our website only for lawful purposes.

You must not use our website, products, systems, or services:

  • For fraudulent or deceptive activity.

  • To interfere with website security or operation.

  • To introduce malicious software or harmful code.

  • To impersonate another person.

  • To violate intellectual-property rights.

  • To violate privacy, surveillance, recording, communications, or other applicable laws.

  • To engage in abusive payment disputes or fraudulent chargebacks.

We reserve the right to restrict or refuse access where reasonably necessary to protect LUSBY, customers, payment providers, or our systems.

3. Product Information

We make reasonable efforts to present product information accurately.

However, minor differences may occur between website content and the product received due to:

  • Product revisions.

  • Manufacturing tolerances.

  • Lighting.

  • Photography.

  • Screen settings.

  • Packaging updates.

  • Software or app updates.

Such differences are not automatically defects where they do not materially change the advertised product or its core functionality.

Nothing in this section permits LUSBY to materially misdescribe a product or avoid mandatory consumer rights.

4. Smart Glasses and Technology Features

LUSBY smart glasses may include features such as:

  • Camera functionality.

  • Photo and video recording.

  • Audio recording.

  • Calls.

  • Music playback.

  • Voice interaction.

  • AI-assisted functions.

  • Image recognition.

  • Translation support.

  • App connectivity.

  • Photochromic lenses.

Some functions depend on compatible devices, applications, internet access, permissions, operating systems, networks, third-party software, AI services, or other services outside LUSBY's direct control.

Feature availability, interfaces, third-party services, compatibility, or software behaviour may change over time.

5. AI, Translation, and Recognition Features

AI-assisted recognition, translation, voice, transcription, or similar features are provided as convenience features.

These technologies can produce inaccurate, incomplete, delayed, context-dependent, or unexpected results.

You should not rely on AI or translation features for situations where an error could cause serious financial, legal, medical, safety, or other significant consequences.

Unless expressly stated otherwise, LUSBY does not guarantee that:

  • Every translation will be accurate.

  • Every object will be correctly recognized.

  • AI output will always be correct.

  • A third-party AI service will remain continuously available.

  • Third-party functionality will remain unchanged indefinitely.

A limitation inherent to an AI or third-party service is not automatically a hardware defect.

6. Recording, Privacy, and Local Laws

LUSBY smart glasses may be capable of recording images, video, and audio.

The customer is responsible for using recording features lawfully.

Laws governing photography, audio recording, surveillance, privacy, consent, workplaces, private property, schools, public spaces, and confidential conversations vary between jurisdictions.

You are responsible for obtaining any consent or authorization legally required before recording, storing, transmitting, or sharing content involving another person.

LUSBY does not authorize unlawful surveillance, recording, harassment, or invasion of privacy.

7. Safe and Proper Product Use

Customers must use LUSBY products responsibly and in accordance with instructions.

You should not use smart glasses in a way that:

  • Distracts you while driving or operating machinery.

  • Obstructs safe vision or awareness.

  • Violates workplace or venue rules.

  • Exposes the device to conditions outside its advertised capabilities.

  • Creates a risk of injury to you or another person.

Damage or loss caused by improper use may not qualify as a product defect.

8. Orders

Submitting an order is an offer to purchase.

An automated order confirmation does not necessarily mean that we have accepted the order in every circumstance.

We may refuse, cancel, limit, or review an order where reasonably necessary because of:

  • Suspected fraud.

  • Unauthorized payment.

  • Pricing or listing errors.

  • Stock errors.

  • Duplicate orders.

  • Shipping restrictions.

  • Incorrect customer information.

  • Technical errors.

  • Abuse of promotions.

  • Payment-provider or risk-review requirements.

If we cancel an order after payment and no lawful amount remains payable, the applicable amount will be refunded.

9. Customer Information

You are responsible for ensuring that all information supplied during checkout is accurate.

This includes:

  • Name.

  • Email address.

  • Telephone number.

  • Billing information.

  • Shipping address.

  • Country.

  • Postal or ZIP code.

LUSBY is not responsible for avoidable delays or additional costs resulting from incorrect information supplied by the customer, except where applicable law provides otherwise.

10. Prices and Payment

Prices are displayed on the website and confirmed during checkout.

Applicable taxes, duties, delivery charges, or other permitted charges may be shown separately.

We may correct genuine pricing, typographical, or technical errors.

Where an obvious pricing error occurs, LUSBY may cancel the affected order and refund the amount paid, subject to applicable law.

Payments may be processed by third-party payment providers.

11. Promotions, Packages, and Free Items

LUSBY may offer:

  • Promotional prices.

  • Limited-time offers.

  • Bundles.

  • Complete packages.

  • Complimentary accessories.

  • Free gifts.

  • Free shipping promotions.

Promotions may be subject to additional stated conditions and may be changed or withdrawn prospectively.

Promotional wording does not remove statutory consumer rights.

Items included as part of a package may need to be returned together where an entire order is returned.

12. Processing and Shipping

Orders are normally processed according to our Shipping Policy.

Processing and delivery dates are estimates unless expressly guaranteed.

Courier delays, customs inspections, severe weather, peak periods, governmental action, transportation disruption, or other events beyond our reasonable control may affect delivery.

Any mandatory delivery rights available under applicable law remain unaffected.

13. Transfer of Risk

Responsibility for loss or damage in transit will transfer at the point required by applicable law.

Where applicable consumer law requires LUSBY to remain responsible until the goods are delivered into the physical possession of the consumer or an authorized recipient, those rules will apply.

14. Order Changes and Cancellations

Customers should review orders carefully before submitting payment.

Once an order has entered processing, fulfilment, or shipping, LUSBY generally cannot guarantee cancellation or modification.

The Return & Refund Policy applies after processing or shipment.

Nothing in this section limits a statutory cancellation or withdrawal right where one applies.

15. Returns, Defects, and Refunds

All returns, replacement requests, defect claims, cancellations, and refunds are subject to our Return & Refund Policy.

That Policy forms part of these Terms.

Where mandatory law provides stronger rights, those rights remain unaffected.

16. Product Warranty and Statutory Rights

Any express product warranty offered by LUSBY is additional to legal rights that cannot be excluded.

A warranty or consumer remedy may not cover damage resulting from:

  • Misuse.

  • Accident.

  • Unauthorized repair.

  • Modification.

  • Improper charging.

  • Neglect.

  • Excessive physical force.

  • Exposure outside advertised environmental limits.

  • Normal wear and tear.

These exclusions apply only to the extent permitted by law.

17. Third-Party Apps and Services

Certain LUSBY functions may depend on applications or services operated by third parties.

LUSBY does not control third-party providers and cannot guarantee that third-party services will:

  • Remain continuously available.

  • Remain free of charge.

  • Remain compatible with every device.

  • Preserve the same functionality indefinitely.

  • Remain available in every country.

Your use of third-party services may also be governed by their own terms and privacy policies.

18. Website Content

Website content is provided for general product and purchasing information.

We may update:

  • Product descriptions.

  • Photographs.

  • Prices.

  • Availability.

  • Specifications.

  • Website layouts.

  • Promotional information.

We will not apply changes retroactively where doing so would unlawfully reduce rights relating to an existing purchase.

19. Intellectual Property

Unless otherwise stated, the LUSBY brand, website design, graphics, text, product presentation, photographs, videos, logos, and other original website content are owned by or licensed to LUSBY.

You may not reproduce, commercially exploit, republish, or distribute protected content without authorization except where permitted by law.

20. Customer Reviews and Submitted Content

If you voluntarily submit reviews, photographs, videos, testimonials, or other content to LUSBY for publication, you represent that:

  • You have the right to submit the material.

  • It does not unlawfully infringe another person's rights.

  • It is not knowingly false or misleading.

Any separate permission requested by LUSBY for marketing use will be governed by the terms of that permission and applicable law.

21. Fraud, Abuse, and Chargebacks

LUSBY may retain and provide relevant transaction records when investigating suspected fraud or responding to a payment dispute.

Relevant evidence may include:

  • Order information.

  • IP/device information where lawfully collected.

  • Payment records.

  • Shipping records.

  • Tracking.

  • Delivery confirmation.

  • Customer communications.

  • Photos or videos.

  • Return records.

Customers retain all lawful rights to dispute unauthorized or improper transactions.

Knowingly making a false claim or fraudulent payment dispute may result in the claim being challenged and may be reported where appropriate and lawful.

22. Disclaimers

To the maximum extent permitted by applicable law, LUSBY does not guarantee that:

  • The website will operate without interruption at all times.

  • Third-party apps or AI services will always remain available.

  • Every technological feature will operate identically on every compatible device.

  • AI-generated or translation output will always be accurate.

  • Minor cosmetic aspects will be identical to website photographs.

Nothing in these Terms excludes any express guarantee made by LUSBY or any warranty that applicable law does not allow us to exclude.

23. Limitation of Liability

To the maximum extent permitted by applicable law, LUSBY will not be liable for indirect, incidental, special, or consequential losses that were not reasonably foreseeable or that arise from matters outside our reasonable control.

Where legally permitted, LUSBY is also not responsible for loss caused by:

  • Unlawful use of recording features.

  • Customer misuse.

  • Unauthorized product modification.

  • Reliance on inaccurate AI or translation results.

  • Third-party software or network failures.

  • Failure to follow instructions.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including any liability that applicable law does not permit a business to exclude.

24. Events Beyond Our Reasonable Control

We are not responsible for failure or delay caused by events outside our reasonable control, including:

  • Courier disruption.

  • Customs delay.

  • Severe weather.

  • Natural disasters.

  • War or civil disturbance.

  • Government restrictions.

  • Network outages.

  • Labour disputes.

  • Supply-chain disruption.

  • Third-party service outages.

This provision does not remove any mandatory legal remedy arising after a legally significant delay or failure.

25. Governing Law

To the extent permitted by applicable law, these Terms and your relationship with LUSBY are governed by the laws of the United Arab Emirates.

Disputes may be submitted to the competent courts in the United Arab Emirates, subject to any mandatory jurisdiction or consumer-protection rule that applies to you.

Nothing in this section deprives a consumer of a protection that applicable law does not permit the consumer to waive.

26. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be limited or removed only to the extent required.

The remaining provisions will continue to apply.

27. Changes to These Terms

We may update these Terms prospectively to reflect changes in:

  • Our products.

  • Our services.

  • Technology.

  • Business practices.

  • Applicable law.

The current version will be displayed on this page with the applicable "Last Updated" date.

Material changes will not retroactively remove rights already acquired under applicable law.
